A Paper on Prorogation
Next week, the Federal Court will hear MacKinnon, the legal challenge to the Trudeau prorogation. In an earlier substack, I outlined my initial thoughts on the case. I have now expanded those thoughts into a draft paper which looks not only at the court case, but also at the Prime Minister and the Governor General’s roles in prorogation. I hope it will be useful to those seeking to understand the issues. Your feedback is very welcome.
The Canadian Constitutional Law Initiative of the uOttawa Public Law Centre, which I lead with Professor Eric Adams, supported by our outside counsel Andrew Bernstein, Jeremy Opolsky, Emily Sherkey and Hudson Manning of Torys LLP and JD student Mallory Dunlop, has been granted leave to intervene in MacKinnon. We look forward to participating in this important case.
